The Department of Geology and Mineral Industries (DOGAMI) Mineral Land Regulation and Reclamation Program (MLRR) issues two types of permits for mining activities:
1. OPERATING PERMIT An Operating Permit is required for mining operations that have an activity level that exceeds one acre and/or 5,000 cubic yards of new disturbance in any 12-month period, unless the excavated material stays on the property.
- Quantity restrictions none (within the permitted area).
- Reclamation is required.
- A reclamation security is required.
- Application fee is $1,260.
- The permit is renewed annually until mining and reclamation are complete. The renewal fee is based on production.
To apply for an Operating Permit, the forms you will use from this packet are: Operating Permit Application (SMLR-1-OP) Operating and Reclamation Plan (SMLR-16)
Also, additional information may be required for an Operating Permit application for sites on floodplains, in hydrologically sensitive areas, or on steep slopes.
NOTE: Before providing additional information or hiring a consultant, we suggest that you contact us to ensure that the data collection and submittal of the additional information will meet application requirements.
Review Application Guidelines for Additional Information Requirements (Revised 9/98) to see if this information may be required for your operation.
2. GRANT OF TOTAL EXEMPTION A Grant of Total Exemption is available for mining operations with an activity level that is less than one acre and/or 5,000 cubic yards of new disturbance in any 12-month period, unless the excavated material stays on the property.
These exemptions are voluntary and are not required by DOGAMI. A Grant of Total Exemption is a certificate issued by the Department stating that the applicant has provided information to us that their activities will not exceed those that would require an Operating Permit.
- Quantity restrictions no more than 5,000 cy or 1 acre disturbed in a 12-month period, unless material is for on-site use.
- Reclamation is not required.
- The application processing charge is $50.
- The exemption may be renewed annually. The annual service charge is $25.
To apply for a Total Exemption, use: Grant of Total Exemption Application (SMLR-1-TE)

Best Managment Practices Manual available:
DOGAMI-MLRR has released a manual for mine operators, landowners, and land-use planners that describes reclamation and mining practices for aggregate mines in Oregon and Washington. The approximately 120-page, extensively illustrated manual provides information about planning a surface mine from start-up to final reclamation, incorporating water and erosion control during operation and reclamation, soil salvage and replacement, land shaping and revegetation. The report has been published as DOGAMI Open-File Report O-96-2 and is available for $8 by calling our Albany-MLRR office or the Nature of the Northwest Information Center in Portland.
